4. The obligation to notify FARCIQ
For written or verbal complaints related to alleged faults, errors or omissions committed in the course of professional activities of licensees and which could be the subject of a professional liability claim, it is important to be aware of the rules and procedures of the Fonds d'assurance responsabilité professionnelle du courtage immobilier du Québec (FARCIQ)
What should a licensee or real estate agency do if they receive a claim, formal demand or any proceedings related to their professional liability?
- The licensee or the real estate agency concerned must immediately report to the FARCIQ any fact, incident or dispute they are aware of, and which could lead to a potential claim, although it seems unlikely that there will be any consequences or a claim. Any failure to notify could cause the licensee or agency to lose the benefits of their coverage.
- To report a fact, incident or dispute, the licensee must complete the Declaration of the insured form, attach the necessary supporting documents and email everything to FARCIQ. For more information, visit the "About claims” section in the Members’ area on farciq.com.
