NOTICE OF SUSPENSION
OF MR. CLAUDE HARRY JEAN’S LICENCE

NOTICE is hereby given that Mr. Claude Harry Jean, former real estate broker (licence no. C8919), whose establishment was located in Laval, has been found guilty by the Discipline Committee of the Organisme d’autoréglementation du courtage immobilier du Québec (OACIQ) of the offences summarized below:

1st count: During the month of February 2008 or around February 2008, concerning an immovable:

a) affixed under the “Offeror” section of the “Offer to purchase a residential property” document, the signature of a promising buyer, in lieu thereof and affixed, under these circumstances, his signature or his initials as a witness to said signature;

b) affixed under the “Acknowledgment of receipt by the offeror” section of the “Offer to purchase a residential property” document, the signature of a promising buyer, in lieu thereof and affixed, under these circumstances, his signature or his initials as a witness to said signature;

committing, on each of these occasions, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

2nd count: During or around the month of March 2008, in the course of steps undertaken to obtain a loan secured by immovable hypothec for the acquisition by the promising buyer of an immovable, sent or allowed someone to send to a bank documents and/or information, which he knew or should have known to be false, the whole contrary to section 13 of the Rules of Professional Ethics of the ACAIQ.

3rd count: As of or around November 24, 2007, concerning an immovable, asked a real estate agent to complete a promise to purchase for a promising buyer, indicating an amount he knew it did not represent the real price offered, thus committing an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

4th count: Concerning an immovable:

a) on or around September 24, 2007, affixed the signature of a promising buyer on a Promise to purchase in lieu thereof;

b) on or around December 10, 2007, affixed the initials of the promising buyer at the bottom of pages 1 to 4 and a promising buyer’s signature on page 7 of the “Mortgage Commitment” document and, under such circumstances, witnessed to said signature;

committing, on each of these occasions, an offence under section 13 of the Rules of Professional Ethics of the ACAIQ.

7th count: On or around July 16, 2009, during an investigation conducted by an assistant syndic:

a) falsely stated having verified the accuracy of an employment letter dated February 13, 2008, concerning a promising buyer;

b) falsely stated that a seller owed him money;

thus committing, on each of these occasions, an offence under section 55 of the Rules of Professional Ethics of the ACAIQ.

On April 19, 2013, the Discipline Committee ordered a suspension of Mr. Claude Harry Jean's real estate broker’s licence (C8919) for a period of six (6) months on each of the counts no. 1, 3, 4, 7a) and 7c) of the formal complaint, and a suspension period of three (3) months on count no. 2 of the formal complaint.

Furthermore, the Committee ordered that the suspension periods imposed on counts no. 1, 2, 3 and 4 be served consecutively and that the suspension periods imposed on counts no. 7a) and 7 c) be served concurrently with each other and consecutively to other counts for a total of twenty-seven (27) months.

Given that Mr. Claude Harry Jean is no longer a licence holder, his licence will be suspended for a period of twenty-seven (27) months whenever he becomes a licence holder again.

This notice is given in accordance with section 33 of the Regulation respecting the issue of broker’s and agency licences (R.R.Q., C-73.2, r.3).
