OACIQ Ombudsman 

The OACIQ Ombudsman is a person who independently and impartially examines public requests related to the processes applied by various OACIQ departments during the processing of a file. If necessary, the Ombudsman may advise the OACIQ departments concerned to improve file processing. 

The Ombudsman is not an appeal body for OACIQ decisions. He is not empowered to review decisions rendered by the Public Assistance Department, the Syndic, the Syndic Decision Review Committee, the Discipline Committee, the Fonds d'assurance responsabilité professionnelle du courtage immobilier du Québec (FARCIQ) or the Fonds d'indemnisation du courtage immobilier (FICI). He does not review the administrative decisions of the OACIQ either.

The OACIQ Ombudsman is a member of the Forum of Canadian Ombudsman and must abide by ethical principles.

Who can approach the Ombudsman?

  • Any member of the public who believes that he or she has been treated in a way that does not comply with the processes established by an OACIQ department.
  • An OACIQ licence holder, only in a situation where he was not acting in that capacity.

When to call upon the Ombudsman?

To enable the Ombudsman to examine your request, your file must first have gone through all the steps set out in the Real Estate Brokerage Act, such as:

  • Syndic's decision: if you are dissatisfied with the Syndic’s decision not to file a complaint with the OACIQ Discipline Committee, the Act provides that you can submit  a review request to the Syndic Decision Review Committee. Once this committee has made its decision, you may turn to the Ombudsman. However, he will not rule on the merits of the decision or review it.
  • The same goes for a claim filed with the FICI or FARCIQ. The final decision of these bodies must first be obtained.

Upon receipt of a review request, the Ombudsman will:

  • Inform the applicant of his role and limitations
  • Analyze any applications received to determine whether the established processes were correctly followed
  • Contact the applicant to inform him of his file’s status and the options available
  • Where appropriate, assist the applicant to try to resolve the problem described in his request   
  • Make recommendations to the Organization, if necessary, to help improve internal policies and procedures

The Ombudsman may refuse to consider or examine an application if he believes that: 

  • it is premature;
  • it is vexatious or made in bad faith;
  • the circumstances show that a review is not necessary.
